Overview

It is unlawful to use any registered pesticide in a manner inconsistent with its labeling. Containers of rinsate must be labeled appropriately and stored in a containment area treated as if they contained pesticide. No person should dispose of or store any pesticide or its container or residue:

  1. In a manner inconsistent with its label or labeling;
  2. So as to cause or allow open dumping of pesticides or pesticide containers;
  3. So as to cause or allow open burning of pesticides or pesticide containers;
  4. So as to cause or allow water dumping or ocean dumping; or
  5. So as to violate any applicable Federal or State pollution control standard.

 

Where more than one type of rinsate is stored, containers used for pesticide rinsate, wash water or other residue-laden liquid, must be segregated and hold only pesticide rinsates and be labeled accordingly.

Rinsate – the liquid produced from the rinsing of the interior of any equipment or container that has come in direct contact with any pesticide.
